Carjacking Laws in Virginia
Carjacking is described under Section 18.2 – 58.1 of Virginia law as the "intentional seizure or seizure of control of a motor vehicle of another with intent to permanently or temporarily deprive another in possession or control of the vehicle of that possession or control."
The law goes on to state that this vehicle seizure may be committed through such means as strangulation, suffocation, striking or beating, or by other violence against the victim or assault or otherwise putting the victim in fear of serious bodily harm. It may also be committed by threatening the victim with a gun or other deadly weapon.
Carjacking is charged as a felony in Virginia punishable by a prison term of not less than 15 years or life in prison and fines of up to $100,000. In cases where a deadly weapon is used against the victim(s), additional years may be added to the minimum of 15 years.
